Tema: A mother and her three adult children, all residents of Germany, have challenged the auction sale of a house at No. 14 Almond Close, Community 20, Tema, claiming they have an ownership interest in the property.
According to Ghana Web, the plaintiffs assert that the house was jointly acquired in 2008 by the first plaintiff and her husband, Peter Nana Kwadwo Ofosu-Ayeh. The property was later attached and sold following a judgment obtained by Skyline Air Limited against Europa Pee Company Ltd and Mr. Ofosu-Ayeh in Suit No. AC/304/2011.
The plaintiffs argue that the judgment and the subsequent execution process were unlawful. They claim that the court failed to pierce the corporate veil of Europa Pee Company Ltd before holding Mr. Ofosu-Ayeh personally liable for the company's debts, which led to the sale of the property.
Furthermore, they maintain that the property was jointly owned and indivisible, making it illegal for their interests in the house to be attached or sold to fulfill the judgment debt. The family is now seeking declarations from the court to nullify the judgment, the attachment of the property, and its auction sale to a third party.
