Accra: Mr Samuel Atta Akyea, counsel for Bernard Antwi Boasiako and Akonta Mining Company Limited, has filed a motion at the High Court seeking deferment of judgement in the Samreboi illegal mining case. The motion, filed on June 22, 2026, requests the court to defer its judgement, which is scheduled for July 3, 2026. The court had previously directed all parties involved to submit written addresses by June 24, 2026.
According to Ghana News Agency, the motion for deferment was filed following the withdrawal of service by Boasiako's previous counsel, Mr Andy Appiah-Kubi, leading to Mr Atta Akyea's appointment as the new attorney. In his filing, Mr Atta Akyea stated that he had requested certified copies of the record of proceedings, which had not yet been provided. He emphasized the necessity of reviewing these documents to adequately prepare and submit competent written submissions on behalf of his clients.
Mr Atta Akyea argued that without access to the complete record of proceedings, it would be challenging to fulfill his professional duties effectively. He maintained that approving the deferment would ensure the effective exercise of constitutional rights and secure a fair trial for his clients. The application, he asserted, is solely aimed at obtaining the necessary documents before the judgement is delivered, not to delay or obstruct justice.
He further highlighted the gravity of the charges against his clients, noting that the verdict could significantly impact their liberty, reputation, rights, and interests. By granting the application, Mr Atta Akyea believes it would enhance public confidence in the judicial process. The hearing of the application is set for June 29, 2026.
