Accra: The Office of the Attorney-General and Ministry of Justice has enlisted the expertise of Gateley Legal and Atuguba and Associates to bolster Ghana's legal defense against a US$1 billion damages claim by Future Global Resources Limited and Blue Gold Holdings Limited. The claim, lodged at the Permanent Court of Arbitration, accuses Ghana of breaching the bilateral investment treaty (BIT) with the United Kingdom concerning the Bogoso-Prestea gold mines. According to Ghana Web, the British company is pursuing damages, citing Ghana's alleged attempt to terminate the leases for the Bogoso and Prestea gold mines as a violation of the BIT. The arbitration proceedings, initiated on April 2, 2025, are being conducted under the 2021 UNCITRAL Arbitration Rules, with an arbitral tribunal comprising Klaus Sachs, Raëd Fathallah, and Mohamed Abdel Wahab overseeing the case. The Bogoso-Prestea gold mine was transferred to Heath Goldfields Ltd., owned by former Finance Minister Dr. Kwabena Duffuor, during President Na na Addo Dankwa Akufo-Addo's administration. The shift occurred under the watch of then-Lands and Natural Resources Minister Samuel Abu Jinapor. Dr. Duffuor was a client of the current Attorney-General, Dr. Dominic Ayine, during Ayine's private legal practice. Speculation persists regarding Ayine's inaction on the matter upon assuming office when John Mahama became President in January 2025, potentially favoring his former client's commercial interests. The Herald highlighted the issue since 2023, facing defamation suits from Dr. Duffour and Heath Goldfield's management. The publication reports multiple efforts by the British company, including communications with the Minerals Commission, the Attorney-General's Department, and the Office of the President, to resolve the matter, all in vain. Tensions have heightened following the involvement of Emmanuel Armah-Kofi Buah, who engaged with Heath Goldfields Ltd. during a visit to the mine amid friction between the company and disgruntled workers, residents, and t raditional authorities. The John Dramani Mahama administration reportedly remained unresponsive to public protests and appeals from affected parties. In November 2024, Mayer Brown International LLP, on behalf of Future Global Resources Limited and Blue Gold Holdings Limited, accused Ghana of unlawful expropriation, asset stripping, and neglecting to protect foreign investments linked to the Bogoso-Prestea Gold Mine. The investors claim ownership of substantial mining interests, asserting that unauthorized parties extracted gold tailings valued at millions of dollars from the mine. Efforts to stop these activities were allegedly hindered by local security forces aligned with the Minerals Commission. The investors argue that the government attempted to transfer the mine and its leases to Heath Goldfields Ltd., violating Ghanaian law and the UK's BIT obligations. They caution that failure to resolve the dispute could lead to significant financial liability for Ghana, potentially affecting its international cre dit standing and future financing. The investors have urged the government to secure the mine and engage in settlement discussions, suggesting meetings in Accra or London. They set a January 14, 2025, deadline for an amicable resolution, failing which they planned to initiate international arbitration proceedings. The arbitration outcome could critically impact the company's operations, with a favorable ruling contingent on securing necessary approvals to restart the mine. Delays or an unfavorable decision could severely affect the company's financial standing, potentially reducing the value of its mineral rights to zero.
