Accra: Counsel for controversial TikToker Mahama Aminat has argued that the facts presented by the prosecution do not support the criminal charges filed against his client. Nana Agyei Baffour Awuah, who is leading the defence, said the case appears weak, particularly because the prosecution has yet to transcribe the video at the centre of the matter.
According to Ghana Web, Awuah stated, "The facts don't support the charge. Indeed, the prosecution themselves say they've downloaded the video; they are yet to do the transcription. So what is contained in the video, we all don't know. Yet, they have come to this conclusion." The lawyer questioned how firm conclusions could be drawn without a proper transcription of the video, arguing that a transcription is necessary for accurate interpretation.
Nana Agyei Baffour Awuah further pointed out that even if the court accepts the prosecution's current version of events, the charge sheet does not support claims of incitement or any direct threat to the life of President John Dramani Mahama. He emphasized that the evidence, as presented, fails to substantiate allegations of intent to harm or incite violence.
While acknowledging that the language used in the video may have been strong, the defence counsel maintained that it does not meet the legal threshold for a felony. He clarified, "I am not endorsing whatever language was used, but the facts don't support the prosecution's claim. And I am sure the judge is aware. So the claim that it is a felony, the charge does not support it. The facts do not support it." a
