Akosua Serwaa Appeals High Court Decision Rejecting Her Marriage Certificate

Kumasi: Akosua Serwaa, widow of the late Daddy Lumba, has filed an appeal against the Kumasi High Court ruling that rejected the marriage certificate she presented in an earlier case.

According to Ghana Web, Akosua Serwaa submitted a suit on December 1, 2025, requesting the Court of Appeal to overturn the decision made by Justice Dorinda Smith Arthur on November 28, 2025. The appeal expresses her dissatisfaction with the High Court’s judgment, which dismissed the validity of her marriage certificate.

The suit highlights several grounds for appeal, arguing that the High Court erred in its ruling. It specifically challenges the court’s determination that the marriage certificate, labeled as exhibits ‘B’, ‘B1’, and ‘B2’, was inadmissible. The court’s reliance on Section 161 of the Evidence Act as a prerequisite for weighing an admitted document was also contested, as was the credibility of the evidence presented by the defendants over that of the complainant.

Akosua Serwaa’s legal representative, William Kusi, called for the entire judgment to be set aside and for a decision to be rendered in her favor. The High Court had previously ruled on November 28, 2025, that both Akosua Serwaa and Priscilla Ofori, known as Odo Broni, should be recognized as surviving wives of the late Highlife musician Daddy Lumba.

The original case saw Akosua Serwaa seeking exclusive recognition as the only surviving wife with widowhood rights. She had also sought to prevent Odo Broni from presenting herself as Daddy Lumba’s spouse or being acknowledged by the Ekuona family head. However, the court found that Akosua Serwaa failed to meet the burden of proof, as she did not provide the original marriage certificate from the Bornheim Marriage Registry or the corresponding certification from the Ghana Embassy in Germany, submitting only an extract instead.
