Siena:The prosecution has called on the High Court to reject a no case submission filed by former National Signals Bureau Director-General Kwabena Adu-Boahene, his wife Angela Adjei Boateng, and their company, Advantage Solutions Limited, concerning the alleged misappropriation of GHS49.1 million in public funds.
According to Ghana Web, Deputy Attorney General Dr. Justice Srem-Sai presented an affidavit arguing against the no case submission, which was filed following a High Court order on September 8, 2026.
The prosecution claims the funds, earmarked for the Bureau of National Communications, were instead transferred to an account linked to a private company and used by the accused individuals and their associates. A cheque for GHS27.1 million was reportedly deposited by Adu-Boahene into an account at Universal Merchant Bank on February 6, 2020, with two additional cheques of GHS1 million and GHS21 million also deposited.
The account was held under the name BNC Communications Limited - Operations, ostensibly a private company connected to the accused through Advantage Solutions Limited. A significant element of the prosecution's case is a payment of GHS9,537,500 allegedly requested by Adu-Boahene for a cyber defence system, supported by a sale contract and invoice. However, the National Signals Bureau has denied any contractual agreement with ISC Holdings Limited in January 2020 for such a system.
The Director of Finance at the bureau, acting as the second prosecution witness, testified that the invoice submitted by the accused did not match bureau records. The records reportedly contain an invoice dated March 30, 2020, for a different system, and there is no inventory record of the cyber defence system's purchase or delivery.
The prosecution asserts that the funds were spent on the accused and their connections, leaving a balance of GHS683,609.65 in the account by August 3, 2020. Two prosecution witnesses have described the sale contract and invoice presented by the accused as not authentic.
Adu-Boahene, his wife, and Advantage Solutions Limited were charged on April 30, 2025, with offences including stealing, conspiracy to steal, defrauding by false pretences, wilfully causing financial loss to the State, using public office for profit, obtaining public property by false statements, and money laundering.
