Accra: Alexander Afenyo-Markin, the plaintiff in a defamation lawsuit against the Chief Executive Officer of the Ghana Gold Board, Sammy Gyamfi, has publicly denied allegations that he is circumventing the service of a writ filed in the ongoing legal proceedings against Gyamfi.
According to Ghana Web, in a statement dated August 29, 2026, Afenyo-Markin addressed the assertions, labeling them as untrue. The legal document was officially submitted on August 24, 2026. Two days following its submission, Gyamfi's legal representatives, Ayine and Partners, communicated to the Registrar of the High Court that they possessed the explicit instructions and authority from their client to receive the service on his behalf.
The statement further detailed that the Bailiff served the writ to Gyamfi's attorneys in accordance with the written commitment. However, Afenyo-Markin claimed that on August 27, the lawyers returned the writ, citing a change in their client's decision regarding the authorization to accept service.
"Our attention has been drawn to false claims that the Plaintiff in the defamation suit against Samuel Adu Gyamfi is avoiding service of the Writ," the statement noted. It continued to clarify the timeline and actions taken, emphasizing that on August 26, Ayine and Partners had acknowledged their ability to accept the service, which the Bailiff subsequently acted upon.
Afenyo-Markin further alleged that an attempt by the Bailiff to personally serve Gyamfi at his place of work was thwarted by security personnel, who then directed the Bailiff to Gyamfi's residence. The statement concluded by asserting, "The position is straightforward: it is not and cannot be the Plaintiff who is avoiding service. It is the Defendant who first authorised his lawyers to accept service, withdrew that authority after service had been effected, and then obstructed an attempt at personal service."
