Accra: Lawyers for former Finance Minister Ken Ofori-Atta have asserted that a US immigration court dismissed allegations related to criminal proceedings in Ghana, stating they lacked credibility within the scope of an immigration case involving Ofori-Atta.
According to Ghana Web, the lawyers issued a statement on June 16, 2026, indicating that the court reviewed evidence concerning actions by Ghana's Office of the Special Prosecutor (OSP), which had declared Ofori-Atta a fugitive while he was reportedly receiving medical treatment in the United States. The court found the criminal charges mentioned in the proceedings to be non-credible for the purposes of the immigration matter.
The statement further elaborated on claims that Ofori-Atta's legal representatives in Ghana maintained ongoing communication with investigators during the relevant period. This aspect was reportedly significant in contesting the fugitive designation.
The lawyers emphasized that the court's decision was strictly within the boundaries of US immigration law, focusing on whether Ofori-Atta met the legal criteria for adjustment of status. They clarified that these findings do not represent a conclusive determination on any criminal liability in Ghana.
Meanwhile, Ghana's Office of the Special Prosecutor has reiterated that Ofori-Atta's acquisition of lawful permanent residency in the United States does not impact the criminal charges he faces in Ghana or the ongoing efforts to secure his extradition. The OSP stated that any immigration status granted by US authorities has no effect on the legal proceedings under Ghanaian law.
