The Reason, Opposition and Request: Inside the Judge’s Decision to Remand Abronye into BNI Custody

Accra: The Minority Leader and Member of Parliament for Effutu, Alexander Kwamena Afenyo-Markin, has shared a case report on the ongoing trial of the Bono Regional Chairman of the New Patriotic Party (NPP), Kwame Baffoe. The document, which was sent to Afenyo-Markin by Abronye DC's lawyers, detailed the events leading to the judge's decision to remand him into the custody of operatives of the Bureau of National Investigations (BNI).

According to Ghana Web, Abronye DC, charged with 'offensive conduct conducive to breach of peace' and 'publication of false news', requested bail through his lawyers when the hearing commenced. The application for bail cited that the offences are misdemeanours and highlighted Abronye's status as a public figure with a fixed place of abode and reliable sureties. The lawyers also emphasized his health condition and family responsibilities.

However, the prosecution objected, arguing that Abronye was likely to repeat the alleged acts if released on bail. Consequently, the judge denied the bail application, remanding Abronye in prison custody pending the case's final determination, as the document detailed.

Concerns were raised regarding the involvement of the BNI in Abronye's detention. The case report clarified that the NPP regional chairman, through his counsel, requested his remand into BNI custody instead of prison. After some hesitation, the judge agreed to this request, resulting in Abronye's remand into BNI custody pending the final outcome of the case.
