His request seeks access to key documents related to the initiation of removal proceedings against the Electoral Commission's head, Jean Mensa, and her deputies, Dr Bossman Asare and Samuel Tettey, under Article 146 of the 1992 Constitution.
According to Ghana Web, Dr Norgbey's petition to the Chief Justice on February 26, 2026, references the Right to Information Act, 2019 (Act 989), underscoring the public's right to transparency in matters that carry national significance. The MP's request specifically includes the original petition, any supporting materials, the committee's response, and the Chief Justice's final report.
Dr Norgbey remains hopeful that the authorities will adhere to the Right to Information Act in providing the requested documents. The Chief Justice, Paul Baffoe-Bonnie, recently dismissed petitions for the removal of Jean Mensa and her deputies, determining that there was no prima facie case. The petitioner, Ofosu-Appiah Daniel, had alleged constitutional violations, citing incompetence, bias, and actions that have undermined public confidence in the Electoral Commission.
The petition, addressed to President Mahama and submitted on January 27, 2025, invokes Article 146 of the 1992 Constitution, arguing that the actions and inactions of the Chairperson and her deputies compromise the integrity of the Electoral Commission and breach constitutional duties. The petition suggests their continued tenure poses a threat to the Ghanaian electoral process.
