Supreme Court of Ghana Rejects Lawyer Kwame Adofo’s Application Against KATH

Kumasi: The Supreme Court of Ghana has dismissed a certiorari application from Kwame Adofo, the former lawyer for the Komfo Anokye Teaching Hospital (KATH), and imposed a fine of GHc20,000.00 on him for filing what it termed a "frivolous" application. According to Ghana News Agency, the dispute began when Adofo, while still employed as the legal counsel for KATH, publicly criticized the hospital and its Chief Executive. His actions led the hospital's management to report him to the General Legal Council, which was asked to investigate his conduct and impose necessary sanctions. Despite the ongoing investigation, Adofo continued to release confidential information about the hospital, breaching a non-disclosure agreement and his duty of trust. The hospital escalated the issue by suing Adofo in the High Court, seeking damages for breach of trust. Adofo responded not by defending the case but by asserting that the High Court had no jurisdiction, given the pending complaint before the General Legal Council. The High Court dismissed his claim and imposed costs against him, prompting him to appeal to the Supreme Court. The Supreme Court, in its ruling, affirmed the lower court's decision, emphasizing the detrimental nature of Adofo's actions to the legal profession. Nana Freduah Agyeman Osborn, representing KATH, argued successfully for the dismissal of the appeal.
