Accra,- The Accra High Court trying ten persons including a female soldier over an alleged high treason has on Monday restored her to her former bail.
Warrant Officer Class Two (WOII) Esther Saan on Wednesday, November 10, 202, failed to attend Court and a bench warrant was issued for her arrest.
The three-member panel of judges presided over by Justice Afia Serwaa Asare-Botwe, ruled that if she was granted bail, she would not attend Court to stand trial, hence, ordered that she should be transported to the Nsawam Prisons.
The Court in restoring the bail said : this ruling is upon a conspiracy to commit crime, treason and high treason.
On November 10 when the Court convened for further cross examination of Staff Sergeant Sule Awarf, WOII Saan was absent without justiciable reasons.
Her Defense Counsel provided two medical reports from Teshie and 37 Military Hospital but none of the reports disclosed that she was admitted.
An Assistant physician who was subpoenaed told the Court that the accused female soldier requested for two days excuse duty to rest.
Her Counsel had earlier prayed the Court that there was a miscommunication
and admitted that his client was not on admission.
The panel then granted the request of the Defense Counsel and granted WOII Saan to bail.
It therefore cautioned all the accused persons to avail themselves to trial as the Court would not hesitate to sanction them if they failed to comply.
Her counsel had earlier informed the Court that she was indisposed and was admitted at an undisclosed hospital.
The Court later received two excuse duty letters from two separate health facilities with different dates.
One was from the Judicial Service Clinic dated Wednesday, November 10 whilst the other from the Kpeshie Military Clinic dated Monday, November 15.
The Court found out that both excuse duty letters did not state that WOII Saan was admitted at the 37 Military Hospital as defense counsel had informed the Court.
The panel discovered that the accused person went to the Judicial Service Clinic to ask for a two-day excuse duty but failed to state that she was standing trial.
WOII Saan is standing trial with Dr Frederick Yao Mac Palm, Chief Executive Officer of the Citadel Hospital, Donyo Kafui, black smith, alias Ezor, Bright Alan Debrah, alias BB, Freight manager, Johannes Zikpi, signaler with the Ghana Armed Forces, Corporal Seidu Abubakar, Corporal Sylvester Akanpewu, Lance Airforce Corporal (LAC) Ali Solomon, Colonel Kojo Gameli and Assistant Commissioner of Police (ACP) Benjamin Agordzo.
They are facing varried charges including conspiracy to commit crime, high treason, possession of ammunitions and abetment.
They have denied the charges and have been granted bail.
