Supreme Court Orders Suspension of Kpandai Election Re-Run

Accra: The Supreme Court on Tuesday issued an order to the Electoral Commission (EC) to halt all preparations for the re-run of the Kpandai Parliamentary election, initially set for December 30, 2025.

According to Ghana News Agency, the five-member panel, led by Justice Gabriel Scott Pwamang, justified the order as a measure to prevent the EC from taking actions that might undermine the Court's examination of a pending motion for certiorari. This motion has been scheduled for a hearing on January 13, 2026.

The Court instructed that its processes be visibly posted at the residence of Mr. Daniel Nsala Wakpal, the 2024 National Democratic Congress (NDC) Parliamentary Candidate and First Interested Party. Additionally, these processes are to be delivered via his WhatsApp line, the Tamale High Court, and the Supreme Court notice boards within a seven-day timeframe.

Mr. Gary Nimako Marfo, representing Mr. Mathew Nyindam, the New Patriotic Party (NPP) Parliamentary Candidate, revealed that an ex-parte motion for judicial review in certiorari had been submitted. He mentioned that a supplementary affidavit filed on December 2, 2025, alongside a motion on notice for suspending the Tamale High Court's decision from November 24, 2025, were also presented to the Court.

Mr. Marfo highlighted the challenges faced in serving Mr. Wakpal, as bailiffs were refused entry at the Chief's Palace, resulting in Mr. Wakpal not being served. As per the Court's earlier instruction, the validity of Mr. Wakpal's phone number was confirmed through a Mobile Money transaction, which succeeded when GHC500 was sent.

Furthermore, Mr. Marfo informed the Court of a press release from the EC expressing its plan to proceed with the re-run. Mr. Justin Amenuvor, representing the EC, stated that confirmation was needed on whether the Commission had the NDC candidate's phone number or email. The panel expressed dissatisfaction with this response, questioning the perceived lack of urgency.

The Tamale High Court, on November 24, 2025, had mandated a re-run of the Kpandai Parliamentary election due to significant irregularities, leading to the EC being informed of a vacancy in the constituency. The seat is presently held by Mr. Nyindam.
