Accra: A High Court in Accra has adjourned to May 19 a petition seeking the winding up of Euroget De-Invest S.A. over a debt exceeding $3 million. The adjournment was to enable Euroget De-Invest S.A., a general engineering and investment firm based in Ghana with its head office in Cairo, Egypt, to be re-served with court processes for the second time after failing to appear in court.
According to Ghana News Agency, Mr. Peter Zwennes, counsel for Top International Engineering Ghana Limited, stated that the court processes had been served on the defendant on April 28, 2026, yet it failed to appear when the case was called on Monday, May 4, 2026. The Court (General Jurisdiction 13) awarded costs of GHS2,000 in favor of the plaintiff, Top International Engineering Ghana Limited, a civil and general construction engineering firm.
Counsel for the plaintiff noted the importance of the defendant's lawyer appearing in court and prayed for costs of GHS5,000, but the court awarded GHS2,000. Top International Engineering Ghana Limited has filed a petition at the High Court seeking the official 'Winding up' of Euroget De-Invest S.A. for insolvency, non-payment of judgment debt, or failure to satisfy a judgment dated September 22, 2021.
The plaintiff is also seeking the appointment of an official liquidator or insolvency practitioner, as well as the cost of the petition. On December 5, 2022, the defendant obtained a Garnishee Order directed at the Ministries of Finance, Health, and Defence to appear before the court and show cause why monies due it should not be paid to the plaintiff.
On March 27, 2024, the parties adopted terms of settlement executed on March 25, 2024, as a Consent Judgement involving an amount exceeding $8 million in relation to two hospital projects in Kumasi and Konongo. The defendant has since made part payments, while the plaintiff has also relied on garnishee processes to recover some of the debt.
An outstanding amount of over $3 million, excluding interest, remains unpaid. The plaintiff has consequently pursued legal processes to enforce the judgment debt, including the present petition for the winding up of Euroget De-Invest S.A., despite the earlier terms of settlement.
