Supreme Court dismisses review application on voting rights of Deputy Speakers

Accra, April 27, GNA- The Supreme Court has unanimously dismissed the review application seeking to reverse its own judgement that a Deputy Speaker of Parliament has a voting right while presiding.

The nine-member review panel presided over by Justice Jones Dotse, in dismissing the review application, said it fell short of the set threshold and had no merit.

The panel included Justices Nene Amegatcher, Professor Ashie Kotey, Mariama Owusu, Lovelace Johnson, Gertrude Torkornoo, Clemence Honyenuga, Prof. Henrietta Mensah-Bonsu, and Justice Yonni Kolendi.

Justice Abdulai contended that, there was a miscarriage of justice in the judgement which warranted a review.

Madam Diana Asonaba Dapaah, a Deputy Attorney General, argued on  point of law that no new matter or exceptional circumstances had been raised to warrant a review.

She said, the application was unmeritorious and abuse of court processes.

Earlier, the Apex Court on Wednesday, March 9, 2022, ruled that Deputy Speakers presiding over proceedings in Parliament had the right to vote on matters and to be counted as part of the quorum for decision-making in Parliament.

The Court held that Deputy Speaker could count himself for purposes of a quorum, and was entitled to an original vote. 

It also said Order 109(3) of the Standing Orders of Parliament of the Republic of Ghana was inconsistent with the 1992 Constitution.

“That the decision of Parliament approving the Government of Ghana budget and economic policy for 2022, taken on the November 30th, 2021, with the Deputy Speaker as part of the quorum of Parliament, is valid,” the Court said.

The Supreme Court again said Ghana’s position on the right of the presiding officer of Parliament to vote on a matter was in consonance with the Law or practice in the Commonwealth and Anglo-American Jurisdictions as the United Kingdom, United States, Canada, Australia, Kenya, and South Africa.

It said the decision of Parliament approving the budget and economic policy of Government on November 30, 2021, was valid. 

However, Mr Abdulai, who is the plaintiff, said it was his submission that the judgment of the Ordinary Bench was per in curium and constituted exceptional circumstances that resulted in the miscarriage of Justice.

He said there had been a discovery of “new and important matter or evidence which, after the exercise of due diligence, was not within the applicant’s knowledge or could not be produced by him at the time when the decision was given.”

Mr Abdalai argued that the Supreme Court, in adjudicating the matter, failed to consider legislative antecedents before making its final judgement.

He said due to the obscure nature of the 1992 Constitution, relating to the voting rights of Deputy Speakers, it was important for the Court to look at legislative antecedents of Articles 102, 104 (1) & (2), 295(2)(a) of the Constitution which came out of the 1957, 1960, 1969, and 1979 Constitutions and other relevant laws to ensure fairness and justice.

He said this would have revealed to the Ordinary Bench of the Court that the original vote of a Deputy Speaker once existed in Parliament but was repealed by NLCD 406 and never returned.

 ”It will have also revealed to them that none of our past Constitutions or enactments ever allowed a Deputy Speaker or a person presiding in Parliament to participate in the quorum of Parliament,” he added. 

He said the failure of the Ordinary Bench to consider the above broader context in interpreting the Constitution in arriving at a decision was inconsistent with the intention of the Framers of the 1992 Constitution. 

The plaintiff said this constituted exceptional circumstance that occasioned miscarriage of justice and therefore the judgment had to be reviewed.

Former Speaker of Parliament calls for reforms in appointment and removal of judges

Accra, April 27, GNA- Professor Aaron Michael Oquaye, former Speaker of Parliament, has called for reforms in the appointment and removal of judges in the 1992 Constitution to strengthen the country’s judicial system.

Prof Oquaye recommended the appointment of two retired Supreme Court Judges nominated by the Roll of Retired Supreme Court Judges, two Senior Lawyers nominated by the Ghana Bar Association, three other persons nominated from the Christian Council, the Catholic Secretariat and the Muslim Council.

These appointments, he explained, would do a better neutral job than the current structure in the 1992 Constitution.

The former Speaker of Parliament was speaking at the launch of Professor Michael Oquaye Centre for Constitutional Studies in Accra organized by the Institute of Economic Affairs, Ghana.

The Centre, established within the Institute will help address the deficit in the country’s Constitution.

The Centre will assist to bring constitutionalism in all the country does, translate the Constitution to the simplest terms and local languages with illustrations.

It will be taught in schools, churches, mosques and civil society generally, to live by the tenets of the Constitution.

Regarding the removal of Judges, Prof Oquaye said the case of Justice Amua Sekyi gave the country the lesson that where the Executive was bent on removing a Judge, it was easier to do so than meets the eye.

“If under Article 146 of the Constitution, the President receives a petition for the removal of a Judge, the President should refer the matter to the Chief Justice (CJ).

“If the CJ is of the view that there is a Prima Facie case, the CJ sets up a committee to investigate the complaint. Three Supreme Court Judges, two other persons (not Lawyers nor from Council of State or parliament), should make a recommendation to the Chief Justice for the suspension of the judge and forwarded to the President for action, “he said.

On decentralization, the former Speaker of Parliament recommended that one-third of appointments by the President should be left to women, and that political parties should operate at the local level.

He said all Chief Executives of Districts, Municipality and Metropolis should be elected to “wean” them off executive control and that District Assemblies’ elections should be two years away from national elections.

On appointment of Council of State members, he suggested the need to introduce institutional and representation and not allow the President to choose his advisors, because the 1992 Constitution gave the President too much power in the appointment of the members.

“We need to adopt the Recommendation of the Committee of Experts which provided that “the Council of State shall aid and counsel the President, the Council of Ministers, Parliament and other organs of State in the performance of their functions under the Constitution or under any other law (Section 3(i)),” he said.

I can still perform despite reports of erectile failure – Referee Kenny Padi

Referee Kenneth Padi has denied media reports that he lost his virility in the aftermath of awarding a penalty against Accra Hearts of Oak in a Ghana Premier League match against Asante Kotoko.

In an exclusive interview with Graphic Online, Referee Padi also denied media reports that he had quit as a Knight of the Whistle.

He added that the publications about his personal life had been traumatic, embarrassing and designed to tarnish his image as a strong man in bed.

“I am so very surprised about the falsehood being peddled about my erection,” Referee Padi who has been banned for the remainder of the season by the Ghana Football Association’s (GFA) Match Review Panel said.

“This is because I have never granted any interview to any radio station, so the rumour that I have not had any erection since the match or I have resigned as a professional referee is completely false” he explained.

“There is nothing wrong with my erection, so I have been enjoying my marriage so much. This is why I was surprised when I heard rumours about my erection.

He vowed to seek legal redress over the reports that he believes were published to ridicule him.

“I have already contacted my lawyer, and he has initiated a suit against all media houses who have been using their medium to embarrass me,” he stated.

On his resignation, he said he had only been suspended by the FA and would continue to be at the centre stage of Ghana football after he had served his suspension.

The Match Review Panel concluded that Referee Padi erred in awarding the penalty which changed the outcome of the match and resulted in a 1-0 victory for Kotoko.

Padi has also been suspended from officiating all GFA organized matches.

At the hearing, referee Padi reportedly insisted that Abdul-Aziz stepped on the foot of Fabio Gama but later agreed that there was no stepping on the foot of the Brazilian after watching the video.

A GFA statement said the referee then, “defended that there was a push and pull at a point, which the video clearly showed that it was not the case”.

The Panel after reviewing the video concluded that there was no foul committed which warranted any penalty.

“The hand on the back of the attacker had no impact on the attacker. More so the attacker should not have fallen backwards if the fall was because of the hand of the defender, obviously, it was not a push so falling backwards suggests a premeditated attempt to fake a foul,” the Panel concluded.

The Panel said the video also showed quite a number of inconsistencies in Referee Padi’s decisions during the match, especially after the penalty incident and attributed it to a loss of concentration.

SOEs not attractive to be listed on Stock Exchange now—Minister

Accra, April 27, GNA- The Government is working to turn around State-owned Enterprises (SOEs) before they are listed on the Ghana Stock Exchange (GSE), Mr Joseph Cudjoe, Minister for Public Enterprises, has said.

Reacting to proposals that SOEs should be listed on the stock market to encourage private sector participation and improve their performance, the Minister said it was the priority of the Government to first make the entities profitable to attract investors.

He made the remarks when he briefed the media on the activities of the Ministry in Accra today, Wednesday, April 27, 2022.

“…when I hear some people say put them (SOEs) on the Stock Exchange, they jump the first question: Have you made them attractive such that when you are listing on the stock exchange, the public as investors will buy the shares?

“We should be mindful of the fact that we have to turn around the companies that are meant for listing and then when they attain profitability and the shares are put on the stock market, people will invest,” Mr Cudjoe said.

The State Interest and Governance Authority (SIGA) has shortlisted 11 SOEs for listing on the GSE.

The enterprises include the Ghana Rubber Estates Limited, the Twifo Oil Palm Plantation, the Ghana National Gas Company Ltd, the Consolidated Bank Ghana Limited, the Ghana Reinsurance Co. Ltd and SIC Life.

The rest are the PSC Tema Shipyard, the State Housing Company Ltd, the TDC Company Limited, GHACEM and GIHOC Distilleries Ltd.

Mr Cudjoe said since 2017, there had been a significant improvement in the performance of Specified Entities (SEs), comprising SOEs, Joint Venture Companies (JVCs) and Other State entities (OSEs) operating in various sectors of the economy.

He said in the 2020 Financial Year, a total of 177 SEs, made up of 51 SOEs, 44 JVCs and 82 OSEs recorded a combined revenue of GHS130.9 billion and a net profit of GHS12 billion, with a total asset of GHS417.7 billion.

“Per the 2020 State Ownership Report, the State Entities employed 76,949 people, representing 24.9 per cent of the total public sector employment of 309,000” he said.

“There has also been an improvement in Financial Reporting and Compliance. In 2020, 132 entities submitted their financial reports as compared to 18 in 2016. We will keep moving until we achieve 100 per cent updated reporting so that management decisions can be made,” Mr Cudjoe added.

He said though SOEs recorded a combined loss of GHS 2.6 billion in the 2020 Financial Year, there had been a reduction in the losses as compared to the GHS 5.16 billion net loss that was recorded in 2019.

Mr Cudjoe appealed to the media to highlight the gains of some of the SOEs that were performing well to erode the impression that all SOEs were making losses.

“As we get excited by the loss-making and always focusing on that, performance isn’t one-direction thing. Those that are doing well must be applauded and in that case when they are encouraged, those that are lagging behind in performance will be motivated,” he said.

Don’t always wait on government, start something on your own—youth urged

Accra, April 27, GNA – Mr Franklin Leonards, Board Chairman of Switch Up Ghana Group, has urged young people to use available digital tools, and social media to start employable ventures on their own instead of always waiting for government employment.

He said they could start such ventures through collaboration and partnership among themselves as well as through digital and media platforms.

“I wish most young people can think and create opportunities for themselves through the adoption of digital platforms and partnerships among themselves. With this, the Government can later come in with the needed support,” he stressed.

Mr Leonards said this while commending a group of young people who had established a culture and tourism venture dubbed “Switch Up Ghana,” an avenue they intend to use to promote Ghana’s culture and tourism industry.

The Switch Up Ghana Group seeks to digitalise the country’s history and heritage to the world thereby creating a platform where people from the diaspora can visit and tour Ghana.

The Group also unveiled its board members comprising Mr Franklin Leonards, who is the Chairperson; Mrs Mavis Leonards, Board Secretary, and Colonel Mustapha Abass.

The rest are Mr Dominic Oduro Antwi and Ms Firdus Salifu.

Mr Leonards called on stakeholders in the history and tourism industry to digitally document Ghana’s culture and heritage in order not to lose them.

“We need to tailor our history in a mordenised, digital way, by adopting technology and social media to sell Ghana’s history,” he added.

He stressed the need to revisit and teach the history of communities and tourism areas in schools and for individuals, especially the youth, not to lose sight of them.

“We cannot sell what we have if we are ignorant of it. Most people do not know much about their history and are losing their sense of culture and heritage,” he reiterated.

Mr Benjamin Oduro Bosompem, CEO of the Organisation, said they intended to give visitors real-time tourism and cultural experience through their organisation.

“We intend to change the narrative of tourism in the country, whereby visitors would have the opportunity to integrate with communities and tourist sites,” he indicated.

He said that they would soon launch a “Switch Up Xperience. Com,” where foreigners and locals could visit and savour tourist sites and communities.

Ellembelle NPP race: Incumbent Chairman to win by 52% — People’s Democratic Governance

The People’s Democratic Governance (PDG) has projected that the incumbent Constituency Chairman of Ellembelle NPP, Samuel Akainya known in a political cycle as Chairman Atito is tipped to win the upcoming constituency elections by 52%.

The People’s Democratic Governance, a reputable political research think-tank conducted same polls in 2018 and predicted a win for Samuel Akainya. The poll projected a vote difference between 30–40 and it’s eventually materialized with a vote difference of 36.

This poll aims to measure the level of popularity among all and a preferred Candidate to win and lead the party for the next four years. The research for this Poll was conducted from 17th to 24th April 2022.

Stratified Sampling technique was employed to classify the Constituency (delegates) into 6 zones plus all the electoral areas coordinators as one zone. 70% of delegates from each zone was randomly selected and interviewed.

The outcome of the fieldwork shows and project that, Samuel Akainya (Atito) will win 4 zones plus more of the coordinators as classified.

Sampson Ndoli (One Man) will win 2 zones whiles Joseph A. Adjei (Boin) will not be able to win any of the zones as categorized for the purpose of the fieldwork.

The research also revealed that Samuel Akainya will win by 52% with a vote difference between 50 –70 and Sampson Ndoli will get 42% whiles Joseph A. Adjei will occupy the last spot with 5% with not more than 50 votes. 1% of the delegates have not decided yet.

It should be noted that current Constituency Executives, Patrons and Council of elders who are also delegates were not part of the sample size considered in this survey.

All results were collated and analyzed in an aggregate format of each zone to protect the identity and confidentiality of respondents.

However, the election will take place at Aiyinasi Park on Monday, April 2, 2022 with thirty (30) candidates who will compete for 10 positions.

Scancom PLC, Vodafone Ghana sign national roaming agreement

MTN Ghana and Vodafone Ghana are pleased to announce significant progress in the bid to implement a national roaming service in Ghana amongst operators. In this regard, MTN Ghana and Vodafone Ghana have entered a strategic partnership to pilot national roaming in the Volta Region as the first step to a broader nationwide national roaming partnership.

This agreement will see Vodafone Ghana expand coverage of its network by leveraging MTN’s network infrastructure in this pilot phase.

National roaming implementation in Ghana is intended to facilitate universal access and accelerate digitalization in line with the country’s ambitions of a digital economy. This pilot is the first step to a bigger plan by Government to have a full national roaming regime amongst all operators in the country.

Patricia Obo-Nai, CEO of Vodafone Ghana in a statement said, “The implementation of national roaming will enable Vodafone Ghana customers to stay connected in areas outside our current locations of coverage.

This is especially important for rural communities as national roaming invariably provides a greater choice of network providers. Liverpool boss Klopp urges players to respect Villareal in Champions League semi

Liverpool coach Jurgen Klopp called on his squad not to underestimate giantkillers Villareal during the first leg of their Champions League semi-final at Anfield on Wednesday night.

Unai Emery’s side disposed of Juventus and Bayern Munich to reach the last four and go into the clash at Liverpool as underdogs.

But Klopp – who led Liverpool to Champions League glory in 2019 – said he would not take the visitors lightly.

“Maybe Juve or maybe Bayern underestimated them,” said Klopp whose side are in a tussle with Manchester City for the English Premier League title.

“But that will never happen to us and especially after those four games against Juventus and Bayern there’s no chance of that anymore.

“So, this little advantage they had might have gone but they’re still a really, really good football team who obviously want to make history as well.”
